Pawly Terms of Service (US)

1. Acceptance of Terms

These Terms of Service govern your access to and use of Pawly, including our website, mobile applications, and related features. By accessing or using Pawly, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility and Accounts

  1. You must be at least 13 years old to use Pawly. If you are under the age of majority in your state, you may use the service only with permission of a parent or legal guardian.
  2. You must provide accurate account information and keep it current.
  3. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.
  4. You may not transfer, sell, lend, or share your account except as expressly permitted by us.

3. The Pawly Service

Pawly provides features for pet profiles, daily records, timelines, community interactions, walk tracking, notifications, and other related tools that we may add, modify, suspend, or remove from time to time.

4. Acceptable Use

You may not:

  • Violate any law or regulation
  • Infringe or misappropriate another person's rights
  • Post unlawful, defamatory, abusive, harassing, hateful, or sexually explicit content
  • Upload malware, interfere with the service, or attempt unauthorized access
  • Scrape, crawl, reverse engineer, or bypass security measures except where prohibited by law
  • Impersonate another person or misrepresent affiliation
  • Abuse subscriptions, refunds, promotions, or platform billing systems
  • Promote animal abuse, dangerous acts, or false professional advice

5. User Content

  1. You retain ownership of content you submit, upload, or create through Pawly, including photos, posts, comments, pet profiles, and journal records.
  2. You grant Pawly a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, adapt, display, and distribute your content as necessary to operate, improve, and provide the service.
  3. If you make content visible to others through community features, you understand that it may be viewed, copied, or reshared by other users consistent with the service design.
  4. We may remove or restrict content that we reasonably believe violates these Terms, our policies, or applicable law.

6. Paid Features and Subscriptions

  1. Certain features may require a paid subscription or other paid purchase.
  2. In-app purchases may be processed by Apple App Store or Google Play. Pricing, billing cycles, free trials, auto-renewal, and cancellation are subject to the applicable platform's billing rules in addition to these Terms.
  3. Unless canceled before renewal, subscriptions may renew automatically for the same subscription period.
  4. Deleting the app does not automatically cancel a subscription.
  5. Refunds for app store purchases are handled according to the applicable app marketplace rules, unless non-waivable law requires otherwise.

7. Third-Party Services

Pawly may integrate with third-party services such as Apple, Google, Firebase, Sentry, AppsFlyer, cloud providers, and other external tools. Your use of third-party services may also be governed by their own terms and privacy policies.

8. Service Availability

We may change, suspend, or discontinue any part of Pawly at any time. We do not guarantee that the service will be uninterrupted, secure, or error-free.

9. Health, Veterinary, and Safety Disclaimer

Pawly is a lifestyle and recordkeeping service for pet owners. It does not provide veterinary, medical, behavioral, training, or emergency advice. Always seek a qualified professional for pet health or safety concerns.

10. Disclaimer of Warranties

To the fullest extent permitted by law, Pawly is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Pawly and its operators, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill arising out of or related to your use of the service.

To the fullest extent permitted by law, our total liability for claims arising from or related to the service will not exceed the greater of one hundred U.S. dollars (USD 100) or the amount you paid us for the paid service giving rise to the claim during the twelve months before the event giving rise to liability.

12. Indemnification

To the extent permitted by law, you will indemnify and hold harmless Pawly and its operators, affiliates, officers, directors, employees, and agents from claims, damages, losses, liabilities, and expenses arising out of your content, your misuse of the service, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk for other users or us, or if we are required to do so by law. You may stop using Pawly and delete your account at any time.

14. Governing Law and Disputes

Unless non-waivable law in your jurisdiction provides otherwise, these Terms are governed by the laws applicable to the service operator, without regard to conflict of law principles. You and Pawly agree to try to resolve disputes informally first by contacting plin@plin.my before filing a legal claim.

15. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date and provide additional notice if required by law. Continued use of the service after the updated Terms become effective means you accept the revised Terms.
